In the name of GOD, Amen, I JOHN KIDD of the City of Philadelphia, Merchant HAVE made Aflurance, and caufe to be aflured (Loft or not Loft) at and from THE PORT OF PHILADELPHIA TO LONDON upon all kind of lawful Goods, CASH or Merchandize, laden or to be laden upon the good SHIP called the GRIFFIN of the Burthen of Tons, or thereabouts, whereof is Matter under GOD, for this prefent voyage JOSEPH ARTHUR or whofoever eife fhall go for Matter in the taid Ship, or by whatfoever other Name or Names the fame Ship, or the Matter thereof, is, or shall be named or called, beginning the Adventure upon the taid lawful Goods or Merchandize, at and from THE PORT OF PHILADELPHIA aforetaid and to fhall continue and endure until the laid Goods and Merchandizes (hall be tafely landed at LONDON aforefaid. And it fhall and may be lawful for the taid Ship, in her Voyage, to proceed and fail to, touch and (lay at any Ports or Places, if thereunto obliged by ftrefs of Weather, or other unaroidable Accident, without Prejudice to this Inturance. Touching the Adventures and Perils, which we the Aflurers are contented to bear, and do take upon us in this Voyage, they are, of the Seas, Men of War, Fires, Enemies, Pirates, Rovers, Thieves, Jettefons, Letters of Mart and Counter Mart, Surprifals, Taking at Sea, Arrests, Restraints and Detainments of all Kings, Princes or People of what Nation, Condition or Quality foever, Baralry of the Mafter and Mariners, and all other Perils, Lofles, and Misfortunes, that have or fhall come to the Hurt, Detriment or Damage of the taid Goods or Merchandize or to any Part thereof. And in case of any Lofles or Misfortunes, it fhall be lawful to and for the Aflured Factors, Servants and Afligns, to tue, labour and travel for, in and about the Defence, Safeguard and Recovery of the taid Goods and Merchandize, or any Part thereof, without Prejudice to this Inturance; to the Charges whereof we the Aflurers will contribute each one, according to the Rate and Quantity of his turn herein aflured. And it is agreed by us the Aflurers that this Writing or Policy of Aflurance, shall be of as much Force and Effect, as the fureft Writing or Policy of Aflurance heretofore made in Lombard-Street, or elsewhere in LONDON, and to we the aflurers are contented, and do hereby promite and bind ourtelves 168 A HISTORY OF THE each one for his own Part, our Heirs, Executors and Goods, to the Aflured THEIR Executors, Adminiftrators and Affigns, for the true Performance of the Premifles, confeffing ourfelves paid the Confideration due unto us for this Aflurance, by the faid Aflured or HIS Affigns, at FOUR y CENT. Memorandum. // is agreed by and between the AJfured and AJJurers, that in Cafe of any Lofs above Five per Cent., there jhall be no Abatement. But that in Cafe of any Average Lofs not exceeding Five Pounds per Cent., the AJfurers, by Agreement, are not to pay or allow any Thing towards fuch Lofs. Itis further agreed. That if any Difpute jhall arife, relating to a Lofs on this POLICY,it jhall be referred to two indifferent Perfons, one to be chofen by the AJJured, the other hy the AJfurer or AJJurers, who jhall have full Power to adjuft the fame; but in Cafe they cannot agree, then fuch two Perfons fh all chufe a Third, and any two of them agreeing, jhall be obligatory to both Parties.
